$7 million Settlement In Medical Malpractice Action

Stewart Leviss, a member of the firm and working with co-counsel, represented parents of a child who sustained severe brain damage during her delivery and birth and which resulted in a $7 million total settlement.  The family alleged that the child’s catastrophic injuries were caused by oxygen deprivation during the labor and delivery process and could have been avoided if the defendant physician had recognized and acted upon clear warning signs demonstrated on a fetal heart monitor.

Stewart and his co-counsel assembled a team of 13 expert witnesses including physicians from Harvard, Yale, Brown and Columbia Universities, UCLA and the University of Pennsylvania.  The settlement, which is subject to an agreement of non-disclosure of the identities of the settling New Jersey hospital and physician, was approved by a Presiding Judge of the Superior Court of New Jersey in February, 2021.
